1. Acceptance of Terms

By accessing or using the Hydr8 application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify you of material changes through the application or by email.

2. Description of Service

Hydr8 is a hydration intelligence platform designed for endurance and high-output athletes. The Service analyzes activity data from connected wearables and user inputs to estimate sweat loss, hydration deficit, and electrolyte depletion during training and competition.

Hydr8 is not a medical device and does not provide medical advice, diagnosis, or treatment. All insights and recommendations are intended for informational and athletic performance purposes only. You should consult a qualified healthcare professional before making any decisions based on information provided by the Service.

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Keep your login credentials secure and confidential
• Accept responsibility for all activity that occurs under your account

You must notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account.

5. Subscriptions and Payments

Hydr8 offers subscription plans ("Engine" and "Apex") that provide access to premium features. By subscribing, you agree to the following:

• Billing: Subscriptions are billed on a recurring basis (monthly or annually) through the Apple App Store, Google Play Store, or other authorized payment platforms. Pricing is displayed at the time of purchase.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Cancellation: You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
• Price Changes: We may change subscription pricing with reasonable notice. Price changes take effect at the start of the next billing period following the notice.

Refund requests are handled by the applicable app store in accordance with their refund policies.

6. Connected Services

Hydr8 may integrate with third-party services, including Apple Health and WHOOP. By connecting these services, you:

• Authorize Hydr8 to access data from the connected service as described in our Privacy Policy
• Acknowledge that third-party services are governed by their own terms and privacy policies
• Understand that Hydr8 is not responsible for the availability, accuracy, or functionality of third-party services

You may disconnect any third-party service at any time through the Hydr8 application settings.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse engineer, decompile, or disassemble any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Attempt to gain unauthorized access to the Service, other accounts, or related systems
• Use the Service to collect, harvest, or store personal data of other users
• Reproduce, distribute, or create derivative works from the Service without our written consent
• Use automated tools, bots, or scripts to access or interact with the Service

We reserve the right to suspend or terminate your account if you violate these Terms.

8. Intellectual Property

The Service, including its design, features, content, algorithms, and branding, is owned by Hydr8 Health and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

You retain ownership of any data you provide to the Service. By using the Service, you grant Hydr8 a limited license to use your data solely to provide and improve the Service as described in our Privacy Policy.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Hydration estimates, recommendations, or other outputs will be accurate or reliable for any particular individual or situation
• The Service will meet your specific requirements or expectations

You use the Service at your own risk. Hydration and electrolyte management during athletic activity involves inherent risks. Always prioritize your safety and consult a medical professional when in doubt.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Hydr8 Health and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or property damage, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Hydr8 Health and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

• Your license to use the Service immediately ceases
• You may request deletion of your data in accordance with our Privacy Policy
• Provisions of these Terms that by their nature should survive termination will remain in effect

You may terminate your account at any time by contacting us or using the account deletion feature within the application.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in California.
